On 31 January 2020, Resolution No. 22/2020 - ANM was published, regulating articles 11 and 18 of Law No. 10,178/2019, setting the maximum deadlines for the National Mining Agency's analysis of various types of mineral applications involving the stages of mining and research.
The deadlines are different according to each type of application sought by the miner, and can vary between 20 and 120 days from the date of filing. However, the deadline will only be taken into account once all the requirements for analysing the application have been met.
The definition of specific dates for the National Mining Agency to analyse applications submitted to it leaves room for legal challenges in cases of excessive delay, since the National Mining Agency itself has now established maximum deadlines for analysing and deciding on applications involving research and mining.
